Part A – Terms and Conditions for Consumers (Online Shop)
A1. Scope and contracting party
- These terms apply to purchase contracts concluded by consumers within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) via the online shop snowbike.com.
- Your contracting party is Brenter GmbH, Arnsdorferstraße 21, 5110 Oberndorf bei Salzburg, Austria, company register FN 67181x (Regional Court Salzburg), VAT ID ATU42729605, phone +43 6272 7777, e-mail office@snowbike.com (hereinafter “Brenter Snowbike”).
- Part B applies to businesses.
A2. Conclusion of contract
- The presentation of products in the shop is not a binding offer but an invitation to place an order.
- Ordering works in these steps:
- Select a product and add it with “Add to cart”
- Check the details in the cart
- Open the order overview with “Proceed to checkout”
- Enter address and contact details, choose a payment method, accept the terms and conditions and the withdrawal information
- Submit a binding offer by clicking the order button (“Buy now”)
- You can correct input errors before submitting in the order overview, with your browser’s back button, or by cancelling and ordering again.
- You will immediately receive an automatic acknowledgement of receipt by e-mail. The contract is concluded when you receive our order confirmation by e-mail within three working days or when we ship the goods.
- The contract languages are German and English. In case of discrepancies, the German version prevails.
- We do not store the contract text separately. You can print or save it with your browser before ordering. We send you the order details, these terms and the withdrawal information by e-mail after your order.
- Order processing is partly automated by e-mail. Please make sure that your e-mail address is correct and that our e-mails are not blocked by your spam filter.
A3. Prices and shipping costs
- All prices are final prices in euros including statutory VAT.
- Shipping costs are shown separately in the cart and before you complete your order.
- For deliveries outside the EU, customs duties and import charges may apply; these are borne by the buyer.
A4. Payment
- The payment methods shown at checkout are available.
- The purchase price is due upon conclusion of the contract.
A5. Delivery and transfer of risk
- We deliver to the delivery address you provide in the countries selectable at checkout. If legal or political conditions change, the selectable delivery countries may be extended or removed at short notice without prior information. Delivery times and shipping costs are listed on our shipping page (snowbike.com/en/shipping-methods/); different delivery times are stated on the respective product.
- The risk of loss of or damage to the goods only passes to you once the goods have been handed over to you or to a third party named by you (§ 7b KSchG).
- If an ordered product is not available, we will inform you without delay and refund any payments already made. If delivery fails for reasons for which you are responsible, you bear the reasonable costs incurred; in the event of a valid withdrawal, the withdrawal information applies to shipping costs.
A6. Retention of title
The goods remain our property until paid in full.
A7. Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days. Details are set out in our withdrawal information.
A8. Warranty
- The statutory warranty under the Austrian Consumer Warranty Act (VGG) and the Austrian Civil Code (ABGB) applies. The warranty period is two years from delivery.
- If a defect appears within one year of delivery, it is presumed to have existed at the time of delivery.
- You may first request repair or replacement and, under the statutory conditions, also a price reduction or termination of the contract.
- Please report defects to office@snowbike.com. Please check the goods for completeness and transport damage on receipt and report any damage to us and the carrier as soon as possible. If you do not do so, or do so later, this has no effect on your statutory warranty rights.
- Used goods (e.g. used snowbikes/skibikes and demo models) are marked as such in the product description, with information on age, condition and signs of use. A deviation from the usual characteristics only applies if you expressly and separately agreed to it before ordering. The statutory two-year period also applies to used goods, unless a reduction to one year is expressly negotiated in the individual case. No additional manufacturer’s guarantee is granted.
A9. Liability
- We are liable without limitation for intent and gross negligence and for personal injury.
- We are not liable for slight negligence, except for personal injury.
- Claims under the Product Liability Act remain unaffected.
- Winter sports involve risks and require basic fitness and the health requirements for sport in the mountains (high altitude). Snowbiking/skibiking/skibob is a sport with a risk of injury. Please follow the enclosed user manual and the slope rules. If you have any health complaints or concerns, please consult your doctor before doing the sport.
A10. Dispute resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board (information pursuant to § 19 (3) AStG).
A11. Applicable law and jurisdiction
- Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
- For actions against consumers resident in Austria, § 14 KSchG applies. Otherwise, the statutory places of jurisdiction apply.
A12. Severability
If any provision is invalid, the remaining provisions remain valid. The invalid provision is replaced by the statutory provision.
Part B – Terms and Conditions for Businesses (B2B)
B1. Scope
- These terms apply to all contracts with businesses. Deviating terms of the contracting party only apply if we agree to them in writing. This also applies if we do not expressly object to them.
- Acts of performance do not constitute acceptance of deviating terms.
B2. Offers and documents
- Our offers are subject to change.
- Cost estimates, brochures, catalogues, samples and presentations remain our intellectual property. Passing them on, copying or publishing them requires our express consent. If no contract is concluded, the documents must be returned.
- The contracting party keeps knowledge obtained from the business relationship confidential towards third parties.
- The contracting party may use the trademarks “SNOWBIKE”, “SKIBIKE” and “BRENTER” only on the basis of a separate licence agreement, for the duration of the cooperation and until revoked.
B3. Prices
- All prices are net, plus statutory VAT, ex works Oberndorf bei Salzburg.
- Unless otherwise agreed, we charge work services according to actual effort at the hourly rates stated in the offer, including travel time. Hours begun are charged as full hours.
- If wage, material, energy, transport or financing costs change after conclusion of the contract, we adjust prices accordingly.
- Partial invoices are permitted. If no written and reasoned objection is raised against an invoice within 2 weeks, it is deemed approved.
B4. Payment and default
- Unless otherwise agreed, invoices are payable within 7 days of receipt without deduction. Receipt in our account is decisive.
- If a partial payment is not made within the discount period, the discount is forfeited for all payments.
- In the event of late payment, we charge default interest of 9.2 percentage points above the base rate (§ 456 UGB) and a flat fee of EUR 40 for collection costs (§ 458 UGB).
B5. Delivery and transfer of risk
- Goods are to be collected; the place of performance is our registered office. Delivery and assembly are provided on request against separate payment.
- Risk passes to the buyer upon provision of the goods or handover to the carrier.
- Minor delays in delivery do not entitle the buyer to withdraw or claim damages.
- In the event of default of acceptance, we may store the goods for a storage fee of EUR 25 per calendar day begun, or withdraw from the contract after a reasonable grace period.
B6. Retention of title
- The goods remain our property until all claims have been paid in full.
- Resale in the ordinary course of business is permitted. In this case, the purchase price claim against the customer is deemed assigned to us.
- In the event of late payment, we may collect the goods at the buyer’s expense. This does not constitute withdrawal from the contract unless we expressly declare it.
B7. Cancellation fee
The buyer may withdraw from the contract without giving reasons against a cancellation fee of 50% of the purchase price (§ 909 ABGB).
B8. Warranty
- The goods must be inspected immediately after delivery. Defects must be notified in writing within 3 days, stating their nature and extent; hidden defects immediately after discovery (§ 377 UGB). Without timely notification, the goods are deemed accepted.
- We choose whether to remedy by repair, replacement or price reduction.
- The buyer must prove that the defect already existed at the time of delivery.
- The warranty period is 12 months from delivery.
- Recourse claims under § 933b ABGB are excluded to the extent permitted by law.
B9. Liability and product liability
- Except for personal injury, we are only liable for intent and gross negligence.
- Recourse claims based on product liability are excluded unless the claimant proves that the defect was caused within our sphere and at least through gross negligence.
B10. Set-off and retention
- Set-off against counterclaims is excluded unless these have been acknowledged by us or established by a court.
- Justified complaints only entitle the buyer to retain a reasonable part of the invoice amount.
B11. Form
Amendments and side agreements must be made in writing. E-mail is sufficient.
B12. Applicable law and jurisdiction
- Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- The place of jurisdiction is the court with subject-matter jurisdiction for our registered office. We may also sue at the contracting party’s general place of jurisdiction.
B13. Severability
If any provision is invalid, the remaining provisions remain valid. It is replaced by a provision that comes closest to the economic purpose.
